Liability Waiver, Assumption of Risk and Release

1. What this is
This Liability Waiver, Assumption of Risk and Release (the "Waiver") applies when you book an extreme-sports or adventure activity (the "Activity") through Apprenaline. By ticking the acceptance box during booking, you accept this Waiver for yourself and for every person you book for (each a "Participant"). This Waiver forms part of your agreement and supplements the Terms of Service.
Who provides the Activity. The Activity is provided, supervised and delivered by an independent third-party operator (the "Operator"), which is the seller of the Activity to you. Apprenaline acts only as the Operator's booking agent — it does not itself provide, supervise or run the Activity. The Operator will also require each Participant to sign its own physical waiver on-site before taking part; this Waiver does not replace that one.
In this Waiver, "Released Parties" means, first, the Operator that provides your Activity and its staff, and, second, Apprenaline Ltd and its officers, employees and agents in their capacity as booking agent.
2. I understand and assume the risks
I understand that extreme-sports and adventure activities — which may include, for example, kitesurfing and water sports, via ferrata and climbing, paragliding and other air activities — are inherently dangerous and carry a real risk of serious injury, permanent disability and death.
These risks arise from, among other things: the nature of the Activity itself; equipment malfunction or failure; weather, water, terrain, altitude and environmental conditions; my own physical condition, health or errors; and the acts or omissions of other participants. I understand that risk cannot be eliminated even when the Activity is run competently.
I confirm that I (and each Participant) voluntarily choose to take part with full knowledge of these risks, and I accept and assume all such inherent risks.
3. My representations about fitness and conduct
I confirm that, for myself and each Participant:
- we are physically fit and medically able to take part, and have no condition (including pregnancy, heart, respiratory, blood-pressure, musculoskeletal or other condition) that would make participation unsafe — or, if we do, we will disclose it and follow medical and Operator advice;
- the weight, height and any health information we provide is true and accurate, and we understand it is used for safe equipment sizing and to apply the Operator's safety limits;
- we will not take part under the influence of alcohol or drugs;
- we will follow the Operator's safety briefing, instructions, rules and equipment requirements at all times; and
- we understand the Operator may refuse or stop a Participant's participation for safety reasons, in its reasonable judgement.
4. Authority to accept for others and for minors
If I book or accept this Waiver on behalf of other Participants, I confirm I have their authority to do so. Where a Participant is a minor, I confirm I am their parent or legal guardian (or authorised by them), I consent to the minor's participation, and I accept this Waiver on the minor's behalf. Operators may set their own minimum-age and supervision requirements.
5. Release and waiver of claims
To the maximum extent permitted by applicable law, I release and agree not to bring any claim against the Released Parties for any loss, damage, injury or expense suffered by me or any Participant arising from the inherent risks of the Activity or from participation in it, except to the extent such loss is caused by the Released Parties' negligence, breach of duty or other liability that cannot lawfully be excluded.
Nothing in this Waiver excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable Hungarian or EU consumer-protection law. This Waiver also does not affect any mandatory consumer rights you have.
6. Indemnity
To the extent permitted by law, I agree to indemnify the Released Parties against claims, losses or expenses arising from my or a Participant's breach of this Waiver, including providing inaccurate health/weight/height information, failing to follow safety instructions, or participating while unfit or under the influence of alcohol or drugs. This does not apply to loss caused by the Released Parties' own negligence or fault.
7. Consent to emergency medical treatment
If I or a Participant suffer injury or illness during the Activity and cannot consent, I authorise the Operator and emergency services to arrange emergency first aid or medical treatment as they reasonably consider necessary. I understand we are responsible for any resulting medical costs, except where covered by insurance or required to be borne by another party under law.
8. Insurance
The Operator is required to hold its own public / general liability insurance for the Activity it provides (see the Operator Agency Agreement). Apprenaline acts as booking agent and does not provide the Activity, and does not provide personal accident, medical or travel insurance for Participants. You are responsible for arranging any personal accident, medical or travel insurance you consider appropriate for the Activity.
9. Acknowledgement
By ticking the acceptance box during booking, I confirm that I have read and understood this Waiver, that I am at least 18 years old, that I accept it voluntarily for myself and on behalf of the Participants I book for, and that I understand it affects my legal rights to the extent the law permits.
10. Governing law and jurisdiction
This Waiver is governed by Hungarian law. As a consumer, you also keep the protection of any mandatory provisions of the law of the country where you are habitually resident, and nothing in this Waiver deprives you of that protection.
You may bring proceedings relating to this Waiver before the Hungarian courts or before the courts of the EU country where you live. Any proceedings brought against you will be brought only before the courts of the country where you live.
